Protect your professional practice against covered claims alleging errors, omissions, negligence or failure in your services.

Clear advice before you choose

Find cover that fits your needs

A client may allege that professional advice, design or service caused financial loss. Even when a professional believes the work was performed correctly, responding to the allegation can involve legal costs, documents and significant management time.

Latron Insurance Agency helps professionals and firms in Kenya compare professional indemnity policies. We explain the limit of indemnity, deductible, covered services, exclusions, retroactive date, claims-notification requirements and whether the policy operates on a claims-made basis.

Understanding your options

What professional indemnity insurance may address

The insurer must assess each notification under the policy wording. Cover varies by profession, insurer and the circumstances of the claim.

01

Errors and omissions

May respond to covered claims alleging a professional mistake, omission or failure in the declared services.

02

Negligence allegations

May cover eligible defence costs and liabilities arising from allegations that professional duties were performed negligently.

03

Legal defence costs

Reasonable defence or investigation costs may be covered when incurred with the insurer's agreement and within the policy terms.

04

Loss of documents or data

Selected policies may include specified costs or liabilities relating to lost client documents or data, subject to exclusions and security requirements.

05

Defamation or confidentiality

Some wordings extend to specified allegations such as defamation or breach of confidentiality arising from professional services.

06

Run-off protection

Where available, run-off cover can address eligible claims reported after a practice closes or changes, subject to the agreed period and retroactive date.

Frequently asked questions

Who needs professional indemnity insurance?+

Businesses or individuals providing professional advice, designs or specialist services may need it because a client can allege that an error, omission or negligent act caused loss. Contracts or professional rules may also specify cover requirements.

What does claims-made mean?+

A claims-made policy generally requires the claim or circumstance to be first notified during an active policy period and to fall within the applicable retroactive terms. Continuous cover and prompt notification are therefore important.

What is a retroactive date?+

It is the date after which the relevant professional act, error or omission must have occurred for a claim to be considered, subject to all other policy terms. Work performed before that date is generally outside cover.

Is professional indemnity the same as public liability?+

No. Professional indemnity generally addresses covered financial-loss claims arising from professional services. Public liability generally concerns covered third-party injury or property damage arising from business activities.

When should I notify a possible claim?+

Notify the insurer or Latron as soon as you become aware of a claim or circumstance that may lead to one. Do not admit liability, settle or incur defence costs without following the insurer's instructions.

Important: This page provides general information, not a policy quotation or financial advice. Cover, limits, exclusions, waiting periods, excesses and eligibility depend on the insurer’s policy wording and underwriting. Latron will help you review the applicable documents before you decide.
